LA GUERRA GIUSTA NEL DIRITTO ROMANO, ANCHE IN PARALLELO CON LA REALTÀ GIURIDICA ATTUALE.

(The righteous war between Roman law and current juridical reality)

Abstract: il concetto di guerra giusta è di difficile elaborazione, tanto nel sistema socio-giuridico europeo attuale quanto nell’antico ordinamento romano. La guerra è una situazione – decisamente traumatica – di conflitto tra più soggetti che incarnano entità etniche e politiche diverse per storia e tradizioni. Alla luce del suesposto dato, oggettivamente incontestabile, è possibile comprendere quanto difficile e forse doloroso si riveli il tentativo (o, meglio, lo sforzo) di giungere ad elaborare in qualsivoglia contesto una nozione del concetto di giustezza della guerra dotato di un apprezzabile grado di plausibilità e ragionevolezza. Su un sentiero così aspro ed accidentato si sono cimentati autorevoli pensatori di tutti i tempi. In questo articolo, al lume delle fonti e delle interpretazioni dottrinarie gradualmente succedutesi nel corso del tempo, si individua la nozione del concetto e descrive la procedura di indizione della guerra giusta nel diritto romano. Nella consapevolezza che, all’interno del sistema socio-giuridico romano, guerra giusta è quella scaturita da un motivo logicamente plausibile (e, ciononostante, tassativamente determinato) e amministrata secondo un ricco e grandioso rituale religioso prestabilito. Le conclusioni coincidono con una riflessione sul concetto di guerra giusta nella realtà socio-giuridica europea attuale.

The concept of the righteous war is difficult to be developed, both in the current European socio-juridical system and in the ancient Roman context. The war is a – definitely traumatic – situation of conflict between several subjects embodying different ethnic and political entities in order to history and traditions. In light of the above, objectively indisputable, it’s possible to understand how difficult, and perhaps painful, is the attempt (or, better, the effort) to come to elaborate, in any framework, a notion of the concept of the justness of the war, endowed with an appreciable degree of plausibility and reasonableness. On this, rugged and bumpy, path authoritative thinkers of all times have ventured. In this article, considering the sources and the doctrinal interpretations that gradually have occurred over time, the author aims to individuate, in the Roman law, the notion of the concept of the righteous war, which was the war risen up from a logically plausible reason (and, nevertheless, strictly determined) and administered according to a rich and magnificent pre-established religious ritual, and describes the procedure for calling it. The conclusions coincide with a reflection on the concept of the righteous war in the current European socio-legal system.
