LA NOVELLA DEGLI ARTT. 9 E 41 COST.: SPUNTI SISTEMATICI TRA PROTEZIONE DELL’AMBIENTE E LIMITI ALLA REVISIONE COSTITUZIONALE

Abstract [It]: lo studio analizza la recente riforma degli artt. 9 e 41 Cost. in materia di ambiente. In particolare, sottolinea come essa costituisce un superamento del metodo delle riforme a “colpi di maggioranza”, avendo raggiunto un ampio consenso nelle Camere. La modifica costituzionale appare anche un abbandono del miraggio della “grande riforma”. L’analisi verte, poi, sulle ragioni per le quali la modifica della Carta fondamentale, da un lato, rispetta i limiti alla revisione costituzionale tracciati dalla giurisprudenza del giudice delle leggi e, dall’altro, ha comunque una grande importanza per la protezione dell’ambiente nell’ordinamento italiano.

Abstract [En]: the paper analyses the recent reform of Articles 9 and 41 of the Italian Constitution concerning the environment. It points especially out how this constitutional revision constitutes an overcoming of the usual method of reforms by “majority blows”. In fact, it managed to obtain a broad consensus in the Parliament. It also defeated the vision – and illusion – of the “great” constitutional reform, by proceeding with little amendments of single provisions. The analysis then focuses on the reasons why the reform, on the one hand, respects the limits to constitutional revision traced by constitutional jurisprudence and, on the other, is nonetheless of great importance for the protection of the environment in the Italian legal system.
