LA VALORIZZAZIONE DELLE “MINIERE URBANE” PER LA TRANSIZIONE ECOLOGICA: NOTE SULLA DISCIPLINA DEL BIOMETANO

Abstract. Il tema della c.d. “transizione ecologica” o “green” è centrale e vivace nel dibattito giuridico recente, sia alla luce delle recenti misure introdotte con il PNRR, sia in virtù delle altrettanto recenti azioni programmatiche dell’Unione Europea. Ma, al fine della transizione di che trattasi, è un problema ex se la città? La risposta è negativa e anzi la soluzione è da rinvenirsi proprio nella medesima dimensione urbana. La città, infatti, contiene due “miniere” che non si esauriscono mai: gli scarti che produce (per l’appunto) e il “sapere” per dargli valore e risolvere i problemi, anche attraverso il sapiente uso della tecnologia. Trasformare gli scarti, attraverso la conoscenza/tecnologia, in soluzioni volte alla transizione green dei contesti urbani è quindi possibile: un esempio di tale commistione è certamente rappresentato dal biometano. In assenza di bussole sul punto, scopo del presente scritto sarà, dunque, quello di ricostruire la recentissima normativa e regolazione del biocombustibile in oggetto, evidenziandone pregi e criticità, con la – auspicata – prospettiva di analizzare funditus la novella tecnica sia da un punto di vista giuridico che sistematico.

Abstract [EN]. The issue of the so-called ‘ecological transition’ or ‘green transition’ is a key and dynamic topic in the recent legal debate, both considering the recent PNRR measures and the likewise recent EU policy actions. However, for the purposes of the transition at hand, is the city a problem ex se? The answer is negative and indeed the solution lies in the urban dimension itself. The city, indeed, contains two ‘mines’ that never run out: the waste it produces (precisely) and the ‘knowledge’ to give it value and solve problems, including through the skilful use of technology. Transforming waste, through knowledge/technology, into solutions aimed at the green transition of urban contexts is therefore possible: an example of such a mixture is certainly biomethane. In the absence of any clear compass on the point, the scope of this paper will therefore be to rebuild the very recent legislation and regulation of the biofuel in question, highlighting its merits and criticalities, with the – expected – aim of analysing the technical novelty funditus both from a legal and systematic point of view.
