IL GIUDICE PENALE DI FRONTE ALLA SOSTENIBILITÀ AMBIENTALE: GESTIONE DEI RIFIUTI E INQUINAMENTO DELLE ACQUE.

ABSTRACT
Nel perseguimento della sostenibilità ambientale, tende a crescere il ruolo del giudice penale in materie assai specialistiche, nelle quali il legislatore non di rado conferisce di fatto una “delega” alla giurisdizione, mediante l’enunciazione di clausole generali che affida all’interpretazione dei giudici il compito di riempire di contenuto.
Anche in materia di rifiuti e di tutela delle acque, il giudice penale si trova non di rado a dover conciliare istanze di tipo precauzionale e di difesa sociale con l’esigenza, propria del diritto penale, di punire solo comportamenti individuali effettivamente offensivi del bene ambiente.

In the pursuit of environmental sustainability, the role of the criminal judge tends to grow in highly specialized matters, in which the legislator often grants a “delegation” to the jurisdiction, through the enunciation of general clauses, thus entrusting the interpretation of the judges with the task of filling them with content. Also in matters of waste and water protection, the criminal judge often finds himself having to balance precautionary and social defense requests with the need, which is typical of criminal law, to punish only individual behavior that is actually offensive to the environment.
