RIFLESSIONI SULL’ACCESSIBILITÀ DELLE AREE NATURALI PROTETTE E DEI BENI CULTURALI

Abstract: [ITA] L’accesso alle aree naturali protette e ai beni culturali costituisce una forma di fruizione e, come tale, è innanzitutto un “servizio, anche se non mancano le ricostruzioni in termini di “funzione” Il biglietto di ingresso è uno strumento per regolare il numero di persone che possono accedere all’area in un determinato periodo di tempo, al pari di altre misure (come p. es. la previsione di un numero chiuso o programmato). Rispetto a queste ultime, però la previsione del ticket consente anche la possibilità di generare entrate significative, e proprio per questo motivo sia la legge quadro sulle aree naturali protette (art. 16 comma 1, lett. f), sia (per i beni culturali) il Codice (artt. 103 e 110) lo prevedono. Nella Regione siciliana un recente intervento normativo (Decreto del Dirigente Generale 31 gennaio 2023, n. 865) ha previsto l’obbligatorietà del pagamento del biglietto di ingresso tramite POS, sia per evitare possibili furti del denaro contante sia per la riduzione dei costi di gestione del servizio. Questa previsione però genera non pochi dubbi di compatibilità con le norme della Costituzione e soprattutto non sembra del tutto compatibile con il diritto alla fruizione del bene, inteso come libertà individuale, da rivalutare in considerazione delle esternalità positive che caratterizzano le aree naturali in termini di benessere sociale e di capacità di favorire lo sviluppo turistico del territorio.

[ENG] Access to protected natural areas constitutes a fruition and, as such, is a “service” but it is also a “function”. The ticket is a tool for regulating access, like other measures (such as, for example, the provision of a programmed number). Compared to the latter, however, the forecast of the ticket also allows the possibility of generating significant revenues. For this reason it is foreseen by the law n. 394/1991 (article 16 paragraph 1, letter f) and by the Code (articles 103 and 110). In Sicily the Decree of the General Manager n. 865/2023 provides for the obligation to pay the ticket via POS, both to avoid possible theft of cash and to reduce the management costs of the service. However, this provision generates many doubts as to its compatibility with the provisions of the Constitution and, above all, it does not seem entirely compatible with the right to use the property, understood as individual freedom, from the point of view of social well-being and the ability to promote tourism development of the territory.
